A retail Certificate of Occupancy is the City of Houston approval that legally allows your store to be occupied and open to the public. Under the City's building code, a Certificate of Occupancy must be obtained before a commercial building — or an individual lease space inside one — may be occupied, and a new certificate is required when an existing occupancy classification changes. A retail buildout in a space that was previously a different use triggers that second condition.

No. The City of Houston requires a Certificate of Occupancy before a commercial building or an individual lease space within one may be occupied. If no certificate is posted, the City may notify the owner or agent to apply and pay inspection fees, and if they fail to comply, citations may be issued each day until the application is made and the fees are paid. Opening ahead of the certificate exposes the business to daily citations on top of the original delay.
It depends on the scope of your buildout, but a permitted retail buildout typically clears structural, electrical, mechanical, and plumbing inspections, plus fire and life-safety review covering exits, occupant load, alarms, and sprinkler coverage where required. Houston's building code states that all work requiring a permit is subject to inspection and must remain accessible and exposed for inspection until approved by the building official.
The City does not publish a guaranteed turnaround, and the real driver is how many open items sit between your project and final sign-off — a clean project with all inspections passed moves quickly, while one failed trade inspection or an unclosed plan-review comment can add weeks. If the occupancy classification is not changing and the space has not been modified, an existing valid certificate may still apply, and a duplicate can be obtained if the original cannot be located. If you altered the space or changed the use, plans and permits must be approved and a new certificate issued for the new use.
